1. Introduction

Thank you for visiting myTravelSite.com™ (“Site”). This Site is operated by Signature Travel Network Cooperative, Inc., a California consumer cooperative corporation. These Terms of Service (“Terms”) govern your access to and use of this Site.

2. Definitions

  1. A “user” is someone who accesses, browses, navigates, uploads, downloads, views, posts or in any way uses the Site.
  2. “You” and “your” refer to you, as a user of the Site.
  3. “We,” “us,” “our,” and “Signature” refer to Signature Travel Network Cooperative, Inc., a California consumer cooperative corporation.
  4. “Content” means text, images, photos, audio, video, and all other forms of data or communication on the Site.

3. Use of this Site Means You Agree to These Terms

THIS SITE MAY BE USED ONLY ACCORDING TO THESE TERMS. BY USING THIS SITE YOU AGREE TO THESE TERMS. PLEASE READ ALL OF THESE TERMS BEFORE USING THE SITE. These Terms restrict your rights and remedies and provide protection to Signature and its member agencies. These also include warranty disclaimers and liability exclusions. By using this Site you acknowledge and agree (a) this is a fair balance because this Site is accessible by you conveniently and at no charge; and (b) if you don't agree or don't want to accept these Terms, you may choose to not use this Site. IF YOU ARE UNWILLING OR UNABLE TO BE BOUND BY THESE TERMS, PLEASE DO NOT USE THIS SITE.

4. Representations and Warranties

You represent and warrant you have the power and authority to agree to and abide by these Terms. You represent and warrant you are at least age 18 and have legal capacity to enter into these Terms.

5. Use of the Site

We grant you permission to use this Site subject to the restrictions in these Terms. In accessing or using the Site, you understand you may be exposed to Content that might be offensive, indecent, hurtful, inaccurate, objectionable, or otherwise inappropriate. Signature and its member agencies will not be liable in any way for any Content, or damages or loss. You acknowledge and agree you are accessing and using the Site at your own risk. You agree to use the Site only for its intended purposes. You agree not to take any action that may compromise security of the Site, render the Site inaccessible to others or otherwise damage the Site or its content. You agree not to add to, subtract from, or otherwise modify the Content, or try to access any Content that is not intended for you. You agree not to use the Site in any way that may interfere with the rights of third parties. You agree not to use this Site in any way that violates any of these Terms, in any unlawful way, or for any unlawful purpose.

6.  Your Representations to Us About Your Content.

You represent and warrant to Signature that any Content you submit is your original work, and does not plagiarize, misappropriate or infringe any work, copyright, trademark, secret or other property right or interest of any other person or entity; and that Content you submit does not breach the confidence of or invade the privacy of or publicity right or other right, property or interest of any person or entity.

 7. Permission to Use Your Content

You grant Signature an exclusive, non-revocable, perpetual, assignable and transferrable worldwide license to use, access, and license others to use and access, any portions of, and all, Content you post. You agree Signature may make any uses, of any and all Content you post, or any portions of such Content, as well as make modifications, for any purposes as Signature sees fit, including but not limited to display on the Site, use elsewhere, reformatting, incorporating into marketing materials, creating derivative works, using or modifying portions in any way, promoting and/or distributing all or any of the Content, and any other usages whatsoever. Signature is not required to attribute the Content to you.

8. Restrictions on Use

You agree you will not, nor assist, encourage or enable others to:

  1. use the Site to harass, intimidate, threaten or stalk any individual, group or entity;
  2. use the Site to submit or transmit spam, junk email, or mass messaging, whether commercial in nature or not;
  3. use the Site for promotional or commercial purposes, except as expressly allowed in writing by Signature;
  4. use the Site in a manner that may create a conflict of interest;
  5. use the Site for keyword spamming or to otherwise attempt to manipulate search results;
  6. use the Site to promote harassment or discrimination against protected classes;
  7. use the Site to violate any third-party right, including but not limited to breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or other intellectual property or proprietary or privacy right or interest;
  8. use the Site to submit or transmit pornography or illegal content;
  9. use the Site to solicit personal information from minors;
  10. imply the Content you post is sponsored or endorsed by Signature or any of its member agencies;
  11. modify, adapt, appropriate, reproduce, distribute, translate, or in any way exploit or misuse this Site;
  12. reverse engineer any portion of the Site;
  13. remove or modify any copyright, trademark or other proprietary rights notice on the Site or on any materials printed or copied off of the Site;
  14. record, track, gauge, process, mine or gather information about other users;
  15. take any action that interferes with the technology infrastructure of the Site;
  16. try to gain unauthorized access to the Site or networks connected to the Site;
  17. disrupt or interfere with the security of, or otherwise cause harm to, the Site.

The above is not exhaustive. You must refrain from using this Site in any way that might violate these Terms or any applicable law.

9.       Indemnification

You acknowledge and agree you are solely and personally responsible for Content you post on this Site and assume all liability associated with such Content, including but not limited to its legality, reliability, appropriateness, originality and copyright, and compliance with all applicable rights of privacy, publicity, and attribution, and any third-party’s reliance thereon. You acknowledge the Content you submit, post or display will be viewed by others and through third-party services and websites. You agree to indemnify, defend and hold harmless Signature and each and all of its member agencies and Signature’s and each and all of its member agencies’ respective owners, subsidiaries, affiliated companies, joint venturers, business partners, licensors, members, directors, officers, employees, agents, and any third-party information providers, from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and attorneys’ fees, resulting from or arising out of Content you submit, your use, misuse, or inability to use the Site, violation by you of these Terms, and any negligent, willful or other culpable act or omission. Signature reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify and you agree to cooperate with Signature in the defense of these claims. You agree not to settle any matter hereunder without prior written consent of Signature.

10.        Privacy

Any information you provide is subject to our Privacy Policy, which concerns how we collect, use and disclose personal information we may receive from your use of this Site.

11.       Third-Party Websites

Any link on this Site to a third-party website is provided only as a convenience to you. Such links do not express or imply endorsement, sponsorship, or recommendation by us of the third-party, the third-party website, or information therein. We are not responsible for availability of any such websites. We are not responsible or liable for any such website or its content. If you use any link to a third-party website, you will leave this Site, and will be subject to the terms of use and privacy policy applicable to those websites.

12. Termination of Use

We reserve the right to remove or refuse to distribute any Content, in whole or in part, in our sole discretion and without notice. We reserve the right to terminate or suspend your use of the Site in our sole discretion and without notice. In the event of any removal, refusal to distribute, termination, or suspension, these Terms continue in full force and effect.

Signature, its various logos, and all product names, company names, and other logos, unless otherwise noted, are trademarks and/or trade dress of Signature or other respective owners (the "Marks"). Use or misuse of any of the Marks or any other materials contained on this Site, without prior written consent is prohibited. The Site design, text, content, selection and arrangement of elements, organization, graphics, images, compilation and other matters related to the Site are protected under copyright laws. 

14.  You Do Not Acquire Rights in Elements of this Site

You do not acquire any rights to any elements viewed through or on the Site. Except as otherwise stated herein, none of these elements may be used, copied, reproduced, downloaded, posted, displayed, transmitted, modified, or distributed in any form or by any means, including, without limitation, electronic, mechanical, photocopying, recording, or otherwise, without our prior written consent.

15. No Copying or Editing

No material from this Site may be modified, copied, reproduced, republished, downloaded, posted, displayed, transmitted, performed, licensed, used to make a derivative work, transferred, sold or distributed in any way, without our prior written consent. You may not frame or mirror any material on this Site on any other server or other location. We reserve the right to exercise whatever means we deem necessary to prevent unauthorized access to or use of the Site.

You may give notice to Signature at any time by letter delivered by registered mail with return receipt the address set forth below. All notices shall be deemed to have been given three (3) business days after mailing or twenty-four (24) hours after email or posting to the Site. Any notices pursuant to Title 17 USC Section 512(c) of the Digital Millennium Copyright Act shall be sent to Signature’s designated agent via email at mts@signaturetravelnetwork.com or registered US mail with return receipt to: DMCA Compliance Agent, Signature Travel Network Cooperative, Inc., 4640 Admiralty Way, Suite 306, Marina Del Rey, CA 90292.

This Site is hosted in the State of California, USA. We make no representation that any material on this Site is appropriate or available for use in any particular location or jurisdiction. Accessing this Site is your decision. You are responsible to comply with local laws, including laws on viewing or receipt of contents of this Site, or on transmission of technical data exported from the USA or the territory where you are located, or using this Site to engage in any transaction.

IN THE EVENT THAT FOR ANY REASON THE ABOVE LIMITS OF LIABILITY ARE NOT ENFORCEABLE OR DO NOT APPLY, SIGNATURE’S LIABILITY, AND THE LIABILITY OF SIGNATURE’S MEMBER AGENCIES, SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW, AND SHALL, IN NO EVENT, EXCEED TWO HUNDRED FIFTY DOLLARS ($250). IN THE EVENT OF A DISPUTE INVOLVING SIGNATURE AND/OR A SIGNATURE MEMBER AGENCY AND A THIRD PARTY, THE LIABILITY OF SIGNATURE AND ITS MEMBER AGENCIES SHALL NOT EXCEED TWO HUNDRED FIFTY DOLLARS ($250).
  7. IF YOU ARE DISSATISFIED WITH THIS SITE, OUR SERVICE, ANY CONTENT ON THE SITE, OR THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP ACCESSING OR USING THIS SITE.

21. General Provisions

  1. These Terms shall be governed by and construed according to California law, without giving effect to conflict of law principles.
  2. The headings in these Terms are just for convenience and have no legal or contractual effect. These Terms are to be interpreted according to their fair meanings, and not strictly in favor of or strictly against any party.
  3. You may not assign, sell, transfer, delegate, or otherwise dispose of, whether voluntarily or involuntarily, or by operation of law, any rights or obligations under these Terms. Any such attempted assignment, transfer, or delegation is void. Nothing herein is intended nor will be deemed to confer rights or remedies on any third party.
  4. No agency, partnership, joint venture, or employment relationship of any kind is created or intended to be created as a result of these Terms, and you do not have any authority to bind us in any respect whatsoever.
  5. Any dispute or controversy arising under or in connection with the services provided by Signature, any one or more of its member agencies, or these Terms (including this particular paragraph) shall be resolved exclusively by arbitration, conducted before the American Arbitration Association in Los Angeles, California, in accordance with its rules then in effect. The arbitrator shall not have authority to add to, detract from, or modify any provision hereof nor to award punitive damages. A decision by the arbitrator shall be final and binding. Judgment may be entered on the arbitrator's award in any court having jurisdiction. Each party shall be responsible for the fees and expenses of their legal representation and the costs of arbitration shall be shared equally. This arbitration provision shall be subject to and the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
  6. By accessing this Site, you are electing to visit us at our host location in California. You accept jurisdiction in California over any dispute that may arise from your accessing, visiting or using this Site. Subject to the arbitration requirement above, legal proceedings against Signature or any Signature member agency may be instituted only in a state or federal court in Los Angeles, California, and any claim involved in such proceedings shall be decided in accordance with the laws of the State of California irrespective of conflicts in law.
  7. No waiver by Signature of any breach or default shall be deemed to be a waiver of any preceding or subsequent breach or default.
  8. In the event any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  9. Signature member agencies are each and all intended to be third party beneficiaries of these Terms.
  10. These Terms are the entire agreement of the parties with respect to the subject matter herein.

We respect rights of authors in original works and protection under the Copyright laws. We expect users to do so as well. Our policy is to terminate access to the Site of a user who repeatedly infringes copyrights. We reserve the right to terminate access to the Site of anyone who uses the Site to infringe copyrights.
